{"id":15739,"date":"2025-02-04T12:37:13","date_gmt":"2025-02-04T11:37:13","guid":{"rendered":"https:\/\/transparency.mk\/?p=15739"},"modified":"2025-02-12T10:19:19","modified_gmt":"2025-02-12T09:19:19","slug":"corruption-barometer-for-january-2025","status":"publish","type":"post","link":"https:\/\/transparency.mk\/en\/2025\/02\/04\/corruption-barometer-for-january-2025\/","title":{"rendered":"CORRUPTION BAROMETER FOR JANUARY 2025"},"content":{"rendered":"<p>Transparency International Macedonia continues to carry out its regular monthly activities for monitoring cases and activities related to corrupt behavior and the fight against corruption, which we\u2019ve named <strong>\u201cLight &amp; Dark\u201d<\/strong><\/p>\n<p>The monitoring of these cases has received significant attention, both in the public sphere and among domestic and foreign relevant stakeholders, and over time, it has evolved into a relevant indicator for measuring corruption and assessing the government\u2019s willingness to address this issue.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><u>\u201cDARK\u201d OCCURRENCES FOR <\/u><\/strong><strong><u>JANUARY 2025<\/u><\/strong><\/p>\n<p><strong><em>\u00a0<\/em><\/strong><\/p>\n<p><strong><em>Reforms in the Judiciary Are Necessary<\/em><\/strong><\/p>\n<p><strong><a href=\"https:\/\/www.slobodenpecat.mk\/razreshena-sudijka-od-veles-i-gazdi-na-lanec-apteki-obvineti-za-falsifikuvanje\/\">Dismissed<\/a><\/strong><strong> Judge from Veles and Pharmacy Chain Owners Accused of Forgery<\/strong><strong> &#8211; <\/strong>The Basic Public Prosecutor\u2019s Office in Kavadarci has filed charges against a judge from the Basic Court in Veles, a married couple who own a pharmacy chain, and a legal entity. They are accused of forging an official document and using a document with false content. The primary defendant, while handling a case in which the other accused were plaintiffs, issued a ruling in their favor, granting them ownership rights over commercial property and land beneath a building. Despite the ruling not being final or enforceable, and the defendants having filed timely appeals, the judge, deliberately influenced by the co-defendants, certified the ruling with an official stamp, falsely marking it as final and enforceable. She then personally handed over the fraudulent document to the manager of the legal entity instead of delivering it through official court channels.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Hundreds of <\/strong><strong>m<\/strong><strong>illions of <\/strong><strong>e<\/strong><strong>uros in <\/strong><strong>b<\/strong><strong>udget <\/strong><strong><a href=\"https:\/\/www.slobodnaevropa.mk\/a\/konfiskacija-imot-mijalkov-gruevski-\/33275770.html\">damage<\/a><\/strong><strong>, <\/strong><strong>m<\/strong><strong>inimal <\/strong><strong>a<\/strong><strong>sset <\/strong><strong>c<\/strong><strong>onfiscation<\/strong><strong> &#8211; <\/strong>Over the past decade, the budget has suffered losses amounting to a total of\u00a0\u20ac244 million, according to an analysis by\u00a0<em>Radio Free Europe<\/em>\u00a0of\u00a030 high-profile court cases. Prosecutors requested the confiscation of assets from around ten defendants, worth approximately\u00a0\u20ac62 million, but the court approved confiscations in only five cases, amounting to\u00a0\u20ac49 million. The decision regarding the apartments of former Prime Minister Nikola Gruevski is still pending from the Government. If the court had approved the full confiscation requested by prosecutors, the\u00a0<em>Agency for Confiscated Property<\/em>\u00a0would have assets worth nearly\u00a0\u20ac62 million\u00a0&#8220;on paper,&#8221; according to\u00a0<em>Radio Free Europe\u2019s<\/em>\u00a0analysis. Out of the 30 analyzed court cases, the court ruled in only five that\u00a0\u20ac49 million\u00a0of the requested\u00a0\u20ac62 million\u00a0should be confiscated. Had these funds been recovered, the state could have, for example, covered the interest on the Hungarian loan for the first three years or built at least\u00a030 new schools. These confiscation rulings, despite being final for years, have not yet been fully executed or collected. The cases in question include\u00a0<em>&#8220;Empire&#8221;<\/em>,\u00a0<em>&#8220;The Vodno Plots&#8221;<\/em>,\u00a0<em>&#8220;Trust&#8221;<\/em>, and\u00a0<em>&#8220;Diamed&#8221;<\/em>.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>New Audit Reports from the State Audit Office<\/strong><strong> (<\/strong><strong>SAO<\/strong><strong>)<\/strong><strong>: <a href=\"https:\/\/www.dw.com\/mk\/revizija-nikako-da-se-pokrie-dupkata-vo-piom-otkrieni-fiktivni-vrabotuvana-i-sporni-nagradi\/a-71434225?maca=maz-rss-maz-pol_makedonija_timemk-4727-xml-mrss\">Pension<\/a> and Disability Insurance Fund of North Macedonia, Protection and Rescue Directorate of North Macedonia, and Dermatology Clinic<\/strong><strong> &#8211; <\/strong>Deficit in the Pension and Disability Insurance Fund \u2013 &#8220;Fictitious&#8221; Employments Discovered the\u00a0<em>State Audit Office <\/em>conducted an audit of the\u00a0<a href=\"https:\/\/www.dw.com\/mk\/mickoski-penziskiot-stolb-e-stabilen\/a-70985887\">Pension<\/a> and Disability Insurance Fund for 2023, issuing an\u00a0adverse opinion\u00a0on the accuracy and objectivity of its financial position. The report highlights ongoing financial issues, including the discovery of\u00a0fictitious employments. <strong>Neglected Property and Lack of National Strategy in the Protection and Rescue <a href=\"https:\/\/mkd.mk\/dzs-ne-gi-odrzhuva-svojot-imot-i-oprema-a-nema-ni-nacionalna-strategija-za-spasuvanje-i-zashtita-predupreduvaat-revizorite-od-dzr\/\">Directorate<\/a> of North Macedonia (<\/strong><strong>PR<\/strong><strong>D)<\/strong> The audit of the\u00a0Protection and Rescue Directorate of North Macedonia\u00a0revealed: Unregistered\u00a0properties from allocated assets, Abandoned and non-functional\u00a0shelters, Outdated, non-operational, and unmaintained\u00a0equipment, No national strategy\u00a0for protection and rescue since 2018, Lack of criteria\u00a0for purchasing firefighting equipment, Insufficient pilots\u00a0for aerial firefighting, Unjustified hiring of an insurance broker\u00a0for aircraft. These findings indicate significant deficiencies in emergency preparedness and resource management. <strong>Financial and <\/strong><strong>o<\/strong><strong>perational <\/strong><strong>c<\/strong><strong>hallenges in the <a href=\"https:\/\/novamakedonija.com.mk\/makedonija\/dzr-slabostite-vo-upravuvanjeto-so-zdravstvenite-uslugi-i-lekovi-sozdavaat-finansiski-i-operativni-predizvici-vo-klinikata-za-dermatologija\/\">Dermatology<\/a> Clinic<\/strong>&#8211; The audit identified\u00a0weaknesses in healthcare service and medicine management, creating\u00a0financial and operational challenges\u00a0for the\u00a0<em>Dermatology Clinic<\/em>. The SAO issued an\u00a0adverse opinion\u00a0on the accuracy and objectivity of financial reports and the compliance of transactions with legal regulations for\u00a0Fund Account 737. For\u00a0Own Revenue Account 531, the SAO issued an\u00a0unqualified opinion\u00a0on financial accuracy but a\u00a0qualified opinion\u00a0regarding compliance with legal regulations.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Officials <\/strong><strong>i<\/strong><strong>gnored <\/strong><strong>the w<\/strong><strong>arnings<\/strong> <strong>from the<\/strong> <strong>State Commission for the Prevention of Corruption<\/strong> <strong>\u00a0<\/strong><\/p>\n<p><strong>Talat <\/strong><strong>Dz<\/strong><strong>aferi <\/strong><strong><a href=\"https:\/\/www.slobodenpecat.mk\/antikorupciska-go-kazni-dzhaferi-bidejkji-vrshel-dve-funkcii-odednash\/\">sanctioned<\/a><\/strong><strong> for <\/strong><strong>h<\/strong><strong>olding <\/strong><strong>t<\/strong><strong>wo <\/strong><strong>i<\/strong><strong>ncompatible <\/strong><strong>p<\/strong><strong>ositions<\/strong><strong> &#8211; <\/strong>The\u00a0State Commission for the Prevention of Corruption (SCPC)\u00a0sanctioned former Speaker of Parliament\u00a0Talat Xhaferifor illegally holding\u00a0two incompatible positions simultaneously. The case was initiated by the political party\u00a0<em>Levica<\/em>, which filed a complaint in\u00a0June 2024, alleging a\u00a0conflict of interest. Dzaferi was serving as both\u00a0Prime Minister\u00a0and\u00a0Member of Parliament, a violation of legal and ethical standards.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Citizens <\/strong><strong>r<\/strong><strong>ate <\/strong><strong>j<\/strong><strong>udicial <\/strong><strong>s<\/strong><strong>ervices a &#8220;<a href=\"https:\/\/www.slobodenpecat.mk\/hhhgragjanite-im-dadoa-trojka-na-sudskite-uslugi-sudiite-zadovolni-za-ministerot-brojkite-se-porazitelno\/\">Three<\/a>&#8221; \u2013 Judges <\/strong><strong>s<\/strong><strong>atisfied, <\/strong><strong>the <\/strong><strong>Minister<\/strong><strong> of Justice<\/strong> <strong>c<\/strong><strong>alls <\/strong><strong>n<\/strong><strong>umbers <\/strong><strong>a<\/strong><strong>larming<\/strong><strong> &#8211; <\/strong>On a\u00a0scale from one to five, citizens who have participated in court proceedings\u2014whether as parties in a case, defendants, users of administrative court services, lawyers, public prosecutors, or journalists\u2014have rated judicial services with an\u00a0average score of three. This was revealed in a\u00a0survey conducted by the Coalition &#8220;All for Fair Trials&#8221;\u00a0at the request of the\u00a0<em>Judges&#8217; Association<\/em>. 9% of the 1,100 respondents\u00a0reported being asked for a\u00a0bribe. One-third of these cases\u00a0involved direct requests from\u00a0judges, while the rest came from\u00a0other court staff. Citizens are\u00a0most dissatisfied\u00a0with the\u00a0speed of court proceedings, which is impacted by an\u00a0increased case loadand a\u00a0shortage of judges\u2014a concern previously highlighted by the Coalition. While\u00a0judges expressed satisfaction\u00a0with the findings, the\u00a0Minister of Justice\u00a0described the numbers as\u00a0concerning\u00a0and indicative of deep-rooted issues in the judicial system.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p><strong><u>\u201cLIGHT\u201d OCCURRENCES FOR <\/u><\/strong><strong><u>JANUARY 2025<\/u><\/strong><\/p>\n<p><strong>Police <\/strong><strong>o<\/strong><strong>fficers <\/strong><strong>t<\/strong><strong>ook <\/strong><strong><a href=\"https:\/\/www.slobodenpecat.mk\/hhhgragjanite-im-dadoa-trojka-na-sudskite-uslugi-sudiite-zadovolni-za-ministerot-brojkite-se-porazitelno\/\">bribes<\/a><\/strong><strong> and <\/strong><strong>s<\/strong><strong>hared the <\/strong><strong>m<\/strong><strong>oney: 16 <\/strong><strong>p<\/strong><strong>eople <\/strong><strong>i<\/strong><strong>ndicted in the &#8220;Premin&#8221; <\/strong><strong>c<\/strong><strong>ase<\/strong><strong> &#8211;<\/strong>After a\u00a0completed investigative procedure\u00a0in the case\u00a0codenamed &#8220;Premin&#8221;, the\u00a0competent public prosecutor submitted an\u00a0indictment\u00a0against\u00a014 individuals\u00a0and a\u00a0prosecution motion\u00a0against\u00a0two more\u00a0to the\u00a0Basic Criminal Court in Skopje. According to the\u00a0charges,\u00a013 customs officers, including one who is\u00a0retired, and a\u00a0police officer\u00a0are accused of\u00a0co-perpetrating the continuous criminal offense of accepting bribes, as defined and punishable under\u00a0Article 357 of the Criminal Code. Additionally,\u00a0nine of the accused\u00a0also committed the\u00a0continuous criminal offense of abuse of official position and authority\u00a0under\u00a0Article 353 of the Criminal Code.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Former Director of the Gazi Baba Utility Company <\/strong><strong><a href=\"https:\/\/360stepeni.mk\/eksdirektor-na-komunalno-pretprijatie-vo-gazi-baba-fiktivno-angazhiral-sezonski-rabotnitsi-podneseno-e-obvinenie\/\">hired fake<\/a><\/strong> <strong>s<\/strong><strong>easonal <\/strong><strong>w<\/strong><strong>orkers \u2013 <\/strong><strong>i<\/strong><strong>ndictment <\/strong><strong>f<\/strong><strong>iled<\/strong><strong> &#8211; <\/strong>The\u00a0Basic Public Prosecutor\u2019s Office in Skopje\u00a0has filed an\u00a0indictment\u00a0against the\u00a0former acting director\u00a0of the\u00a0public utility company &#8220;Gazi Baba 2007&#8221;\u00a0for\u00a0embezzling funds\u00a0through\u00a0fraudulent seasonal worker contracts. He indirectly requested a \u20ac150 bribe from the patient&#8217;s son, stating it was &#8220;to treat himself&#8221; for the work done. \u00a0The son handed the doctor an envelope with three marked \u20ac50 banknotes inside the hospital.
