Asnj\u00eb institucion shtet\u00ebror nuk ka p\u00ebrcaktuar person q\u00eb do t\u00eb paraqet krimet, nuk ka ekip q\u00eb do t\u00eb veproj\u00eb sipas paraqitjeve dhe n\u00eb asnj\u00eb organ kompetent \u2013 Prokurorin\u00eb Publike, MBP, Anti-korrupsion&#8230;nuk \u00ebsht\u00eb caktuar n\u00ebpun\u00ebsi p\u00ebr zbatimin e ligjit. Shihet qart\u00eb q\u00eb, t\u00eb p\u00ebrballuar me hulumtimet e PSP, kreu i pushtetit ka frik\u00eb nga paraqitje t\u00eb reja p\u00ebr vepra penale<\/div>\n<div><\/div>\n<div>N\u00eb nj\u00eb nat\u00eb n\u00ebntori, vjeshte, disa minuta para mesnat\u00ebs, me procedur\u00eb urgjente, deputet\u00ebt n\u00eb parlament kan\u00eb votuar disa ligje t\u00eb reja dhe disa ndryshime t\u00eb t\u00eb vjet\u00ebrve. T\u00eb gjitha kan\u00eb dal\u00eb nga marr\u00ebveshja e par\u00eb n\u00eb P\u00ebrzhino. N\u00eb diskutimin e vrullt\u00eb rreth ndryshimeve t\u00eb Kodit Zgjedhor, p\u00ebr at\u00eb n\u00ebse dhe a do t\u00eb voton diaspora, n\u00eb heshtje ka kaluar Ligji p\u00ebr Mbrojtjen e Informator\u00ebve (paraqit\u00ebs, \u201cfishk\u00ebllyes\u201d). Po t\u00eb nj\u00ebjt\u00ebn nat\u00eb, me energji t\u00eb plot\u00eb, u votua edhe nj\u00eb ligj i ri, i imponuar nga audio-incizimet e siguruara nga LSDM \u2013 Ligji p\u00ebr Mbrojtjen e Privat\u00ebsis\u00eb. K\u00ebt\u00eb ligj e ka shtyr\u00eb p\u00ebrpara pushteti sepse duheshe t\u00eb gjej\u00eb nj\u00eb m\u00ebnyr\u00eb si t\u00eb ndaloj\u00eb eksplozionet e opozit\u00ebs, q\u00eb me p\u00ebrmbajtjen e tyre synohej de-maskimi i drejtp\u00ebrdrejt\u00eb i funksionar\u00ebve t\u00eb VMRO-DPMNE.<\/div>\n<div><\/div>\n<div><\/div>\n<div><\/div>\n<div>Si p\u00ebrgjigje e k\u00ebsaj, opozita ka mb\u00ebshtetur Ligjin p\u00ebr mbrojtjen e informator\u00ebve. T\u00eb ju p\u00ebrkujtojm\u00eb se n\u00eb seanc\u00ebn e nj\u00ebjt\u00eb u votua edhe Ligji p\u00ebr qeveri \u2013 p\u00ebr p\u00ebrb\u00ebrjen teknike t\u00eb saj sipas Marr\u00ebveshjes s\u00eb P\u00ebrzhinos, por u formua edhe Komisioni anketues p\u00ebr p\u00ebrgjimin, i cili nuk i p\u00ebrfundoi obligimet e veta.<\/div>\n<div>Dhe \u00e7far\u00eb ndodhi n\u00eb nd\u00ebrkoh\u00eb? \u00a0Ligji p\u00ebr informator\u00eb, q\u00eb kushtimisht i konvenon opozit\u00ebs, por para s\u00eb gjitha publikut dhe qytetar\u00ebve, deri sot nuk funksionon n\u00eb praktik\u00eb, por p\u00ebr k\u00ebt\u00eb shkak Ligji p\u00ebr mbrojtje t\u00eb privat\u00ebsis\u00eb, i cili \u00ebsht\u00eb n\u00eb dobi t\u00eb VMRO-DPMNE dhe me t\u00eb cilin u ndaluan \u201cdetonimet\u201d e reja politike zbatohet fuqish\u00ebm, n\u00ebse nuk i llogarisim audio-incizimet e reja q\u00eb shpallen n\u00eb Kosov\u00eb dhe kan\u00eb t\u00eb b\u00ebjn\u00eb me politikan\u00ebt shqiptar nga Maqedonia.<\/div>\n<div>Dometh\u00ebn\u00eb, qeveria ka arritur q\u00ebllimin dhe i ka parandaluar \u201cbombat\u201d, q\u00eb i shkaktuan d\u00ebm t\u00eb madh, t\u00eb vazhduesh\u00ebm dhe t\u00eb pandreqsh\u00ebm, por paralelisht nuk b\u00ebri gj\u00eb p\u00ebr t\u00eb siguruar q\u00eb institucionet t\u00eb nisin me zbatimin e Ligjit p\u00ebr mbrojtje t\u00eb informator\u00ebve. \u00a0Ky ligj duhet t\u00eb inkurajon t\u00eb pun\u00ebsuarit n\u00eb institucionet qeveritare t\u00eb paraqesin korrupsion dhe krim t\u00eb organizuar, q\u00eb do kishte ndihmuar shum\u00eb Prokurorin\u00eb speciale publike, e cila ballafaqohet me pengesa serioze n\u00eb p\u00ebrpjekjet p\u00ebr goditje financiare t\u00eb funksionar\u00ebve t\u00eb korruptuar.<\/div>\n<div>Edhe pse u votua n\u00eb n\u00ebntor, gati se para nj\u00eb viti, dhe edhe pse u parapa zbatimi i tij t\u00eb nis n\u00eb mars, kur Ministria p\u00ebr drejt\u00ebsi n\u00eb koh\u00eb i p\u00ebrgatiti aktet n\u00ebnligjore, p\u00ebrs\u00ebri ligji mbetet n\u00eb let\u00ebr. Asnj\u00eb parakusht t\u00eb parapar\u00eb n\u00eb Ligjin p\u00ebr mbrojtje t\u00eb informator\u00ebve nuk \u00ebsht\u00eb plot\u00ebsuar, dhe kjo dometh\u00ebn\u00eb se asnj\u00eb \u201cfishk\u00ebllyes\u201d edhe pas nj\u00eb viti, nuk \u00ebsht\u00eb i mbrojtur.<\/div>\n<div>Komisioni i Venedikut, me detyr\u00eb p\u00ebr vler\u00ebsim dhe kontroll t\u00eb zgjidhjeve ligjore, ka mendim p\u00ebr dy ligjet. P\u00ebr at\u00eb p\u00ebr mbrojtjen e privat\u00ebsis\u00eb, v\u00ebrejtjet dhe sugjerimet jan\u00eb m\u00eb serioze, nd\u00ebrsa p\u00ebr mbrojtje t\u00eb informator\u00ebve Komisioni potencon disa l\u00ebshime t\u00eb r\u00ebnd\u00ebsishme, q\u00eb nga ana tjet\u00ebr, nuk do t\u00eb thon\u00eb q\u00eb ligji nuk duhet t\u00eb zbatohet.<\/div>\n<div><\/div>\n<div><b>NUK KA M\u00cbNYR\u00cb SI QYTETAR\u00cbT N\u00cb M\u00cbNYR\u00cb PUBLIKE T\u00cb PARAQESIN KRIMIN<\/b><\/div>\n<div><\/div>\n<div>Gjithsesi q\u00eb ky status kuo i situat\u00ebs shkon n\u00eb dobi t\u00eb VMRO-DPMNE dhe t\u00eb BDI, nd\u00ebrsa, ata, nga ana tjet\u00ebr, me metoda t\u00eb ndryshueshme me sukses e ndalojn\u00eb zbatimin e ligjit. \u00c7far\u00eb kurthi ka vendosur pushtetit-ligji p\u00ebr \u201cfishk\u00ebllyesit\u201d nj\u00eb vit t\u00eb q\u00ebndroj\u00eb vet\u00ebm n\u00eb let\u00ebr?<\/div>\n<div>N\u00eb ligjin jan\u00eb parashikuar tre lloje t\u00eb denoncimesh \u2013 t\u00eb brendshme, t\u00eb jashtme dhe publike. Sipas zgjidhjes ligjore, p\u00ebr t\u00eb mundur nj\u00eb informator n\u00eb m\u00ebnyr\u00eb publike t\u00eb shpreh d\u00ebshmit\u00eb ose njohurit\u00eb p\u00ebr ndonj\u00eb rast t\u00eb caktuar kriminel-korruptues, paraprakisht duhet t\u00eb kaloj\u00eb n\u00ebp\u00ebr fazat e denoncimit t\u00eb brendsh\u00ebm dhe t\u00eb jasht\u00ebm. Kjo n\u00eb fakt do t\u00eb thot\u00eb q\u00eb denoncuesi nj\u00ebher\u00eb duhet t\u00eb denoncoj\u00eb n\u00eb institucionin n\u00eb t\u00eb cilin punon (denoncim t\u00eb brendsh\u00ebm), pastaj tek autoritete p\u00ebrkat\u00ebse hetimore si\u00e7 jan\u00eb Prokuroria Publike, policin\u00eb (denoncim t\u00eb jasht\u00ebm), p\u00ebr t\u00eb mundur t\u00eb flet n\u00eb publik p\u00ebr rastin (n\u00eb mediet).<\/div>\n<div>Megjithat\u00eb, zbatimin e ligjit pushteti n\u00eb m\u00ebnyr\u00eb t\u00eb qart\u00eb e ndalon. N\u00eb institucionet shtet\u00ebrore nuk ka sistem dhe nuk ka t\u00eb p\u00ebrcaktuar procedur\u00eb si nj\u00eb \u201cfishk\u00ebllyes\u201d mund t\u00eb denoncoj\u00eb krim, me t\u00eb cil\u00ebn \u00ebsht\u00eb rrezikuar denoncimi i brendsh\u00ebm. Asnj\u00eb institucion nuk ka p\u00ebrcaktuar person tek i cili mund t\u00eb denoncohet, nuk ka t\u00eb formuar ekip q\u00eb do t\u00eb veproj\u00eb sipas denoncimeve, do t\u00eb analizoj\u00eb nivelin e seriozitetit t\u00eb denoncimit, do t\u00eb hap rast p\u00ebr hetim, ose me nj\u00eb fjal\u00eb, do t\u00eb zbatoj\u00eb procedur\u00ebn p\u00ebr mbrojtje t\u00eb informator\u00ebve paralelisht me hetimin e nivelit t\u00eb seriozitetit dhe relevanc\u00ebn e pohimeve t\u00eb shprehura p\u00ebr krim.<\/div>\n<div>M\u00eb tutje, metod\u00ebn e nj\u00ebjt\u00eb pushteti e p\u00ebrdor edhe p\u00ebr mund\u00ebsin\u00eb e denoncimit t\u00eb jasht\u00ebm. Asnj\u00eb prej organeve shtet\u00ebrore nuk ka p\u00ebrcaktuar person q\u00eb do t\u00eb zbatoj\u00eb ligjin. Prokuroria Publike, Ministria e Pun\u00ebve t\u00eb Brendshme, Komisioni kund\u00ebr Korrupsionit, Avokati i Popullit \u2013 t\u00eb gjith\u00eb kan\u00eb obligim ligjor t\u00eb krijojn\u00eb kushte p\u00ebr denoncim t\u00eb jasht\u00ebm t\u00eb mbrojtur. Megjithat\u00eb, k\u00ebto institucione heshtin p\u00ebr at\u00eb q\u00eb nuk e zbatojn\u00eb ligjin!<\/div>\n<div>Do t\u00eb thot\u00eb, si n\u00eb rastin e me pengesat e PSP, taktika e qeveris\u00eb \u00ebsht\u00eb e qart\u00eb dhe e thjesht\u00eb. Q\u00ebllimi p\u00ebrfundimtar \u00ebsht\u00eb \u2013 ligji asnj\u00ebher\u00eb mos t\u00eb funksionoj\u00eb. N\u00eb ligjin \u00ebsht\u00eb parashikuar q\u00eb informatori nuk guxon t\u00eb publikoj\u00eb n\u00eb publik krim ashtu t\u00eb p\u00ebrfitoj\u00eb mbrojtje, n\u00ebse paraprakisht nuk e ka b\u00ebr\u00eb n\u00eb parimin e denoncimit t\u00eb brendsh\u00ebm ose t\u00eb jasht\u00ebm. Mir\u00ebpo, k\u00ebto dy m\u00ebnyra p\u00ebr denoncim nuk funksionojn\u00eb n\u00eb praktik\u00eb. Ajo do t\u00eb thot\u00eb q\u00eb informatori i vepr\u00ebs kriminele nuk guxon publikisht n\u00eb medie t\u00eb shpreh d\u00ebshmi, informacione ose njohuri p\u00ebr rast kriminel-korruptues dhe ashtu t\u00eb ket\u00eb trajtimin e informatorit t\u00eb pambrojtur, n\u00ebse paraprakisht nuk i ka plot\u00ebsuar dy denoncimet e para q\u00eb nuk mund assesi t\u00eb realizohen. Ja me \u00e7far\u00eb leht\u00ebsi pushteti i ndalon informator\u00ebt mos t\u00eb flasim asnj\u00eb p\u00ebr korrupsionin dhe krimin n\u00eb institucionet shtet\u00ebrore.<\/div>\n<div>Sqaruar m\u00eb thjesht\u00eb, pushteti t\u00eb ndalon n\u00eb m\u00ebnyr\u00eb publike t\u00eb flas\u00ebsh p\u00ebr krimin dhe gjat\u00eb k\u00ebsaj t\u00eb jesh i mbrojtur, sepse nuk i ke plot\u00ebsuar dy kushtet paraprake t\u00eb ligjit, dhe t\u00eb cilat nuk t\u00eb lejon t\u00eb plot\u00ebsosh. Gjeniale!<\/div>\n<div><\/div>\n<div><\/div>\n<div><b>SHTETI DO T\u00cb D\u00cbNOJ\u00cb FIRMAT, POR KUSH DO T\u00cb D\u00cbNOJ\u00cb SHTETIN?<\/b><\/div>\n<div><\/div>\n<div>Mir\u00ebpo, a do t\u00eb mund VMRO-DPMNE edhe pas v\u00ebrejtjeve t\u00eb shumta serioze t\u00eb Komisionit t\u00eb Venedikut as leht\u00eb t\u00eb sille dhe t\u00eb hesht injorimin e plot\u00eb t\u00eb ligjit? Informacionet jozyrtare konfirmojn\u00eb q\u00eb deri n\u00eb zgjedhje, Qeveria duhet t\u00eb siguroj\u00eb q\u00eb ligji t\u00eb funksionoj\u00eb. P\u00ebr k\u00ebto shtat\u00eb ose tet\u00eb muaj, kur ishte pritur t\u00eb ket\u00eb edhe shum\u00eb denoncime, pasi q\u00eb ligji \u00ebsht\u00eb n\u00eb fuqi, shum\u00eb qytetar\u00eb kan\u00eb denoncuar raste n\u00eb OJQ \u201cTransparency International\u201d, nd\u00ebrsa nj\u00eb num\u00ebr i tyre kan\u00eb pyetur si mund n\u00eb institucionet t\u00eb paraqesin sjellje t\u00eb paligjshme. N\u00eb p\u00ebrgjith\u00ebsi, qytetar\u00ebt m\u00eb tep\u00ebr do t\u00eb preferonin denoncim t\u00eb jasht\u00ebm, do t\u00eb thot\u00eb n\u00eb MBP, prokurori, komisionin kund\u00ebr korrupsionit&#8230;sesa t\u00eb brendshme, sepse aty, n\u00eb institucionin n\u00eb cilin punojn\u00eb, kan\u00eb frik\u00eb q\u00eb do t\u00eb zbulohem shpejt\u00eb. Si t\u00eb zgjedhin ku t\u00eb b\u00ebjn\u00eb denoncimin n\u00eb kushte kur nuk kan\u00eb zgjedhje?<\/div>\n<div>Megjithat\u00eb, loja manipuluese e qeveris\u00eb nuk p\u00ebrfundon vet\u00ebm me bllokimin e plot\u00eb t\u00eb informator\u00ebve. Q\u00eb t\u00eb jet\u00eb absurdi i plot\u00eb, ajo synon q\u00eb ligji t\u00eb zbatohet n\u00eb sektorin privat. N\u00eb fakt, nj\u00eb num\u00ebr i kompanive, t\u00eb frik\u00ebsuar me inspeksione, kan\u00eb vendosur njoftime n\u00eb zyrat e kompanive q\u00eb t\u00eb pun\u00ebsuarit q\u00eb kan\u00eb informacione p\u00ebr korrupsion ose krim t\u00eb denoncojn\u00eb tek personi i caktuar q\u00eb emri dhe mbiemri \u00ebsht\u00eb theksuar n\u00eb tabel\u00ebn e shpalljeve \u00eb firmat. Disa kompani madje edhe kan\u00eb zbatuar trajnime t\u00eb organizuar nga odat ekonomike, n\u00eb t\u00eb cilat jan\u00eb dh\u00ebn\u00eb ligj\u00ebrata p\u00ebr zbatimin e ligjit.<\/div>\n<div>Por, duke marr\u00eb parasysh q\u00eb n\u00eb sektorin privat pun\u00ebtor\u00ebt jan\u00eb kryesisht t\u00eb frik\u00ebsuar t\u00eb denoncojn\u00eb, ve\u00e7an\u00ebrisht v\u00ebshtir\u00eb marrin guximin t\u00eb denoncojn\u00eb eprorin e vet, del q\u00eb kompanit\u00eb e respektojn\u00eb ligjin sepse kan\u00eb frik\u00eb nga gjoba p\u00ebr moszbatimin, dhe jo q\u00eb v\u00ebrtet\u00eb besojn\u00eb q\u00eb dikush do t\u00eb paraqet vep\u00ebr penale. Megjithat\u00eb, b\u00ebhet fjal\u00eb p\u00ebr kompani private dhe n\u00ebse nuk zbatojn\u00eb ligjin, ato ka kush t\u00eb d\u00ebnoj\u00eb \u2013 shteti!<\/div>\n<div>Por, kush do t\u00eb d\u00ebnoj\u00eb shtetin? Kush do t\u00eb sanksionoj\u00eb institucionet shtet\u00ebrore q\u00eb nuk veprojn\u00eb sipas ligjit? Kush merr p\u00ebrgjegj\u00ebsin\u00eb p\u00ebr heshtjen e plot\u00eb rreth moszbatimit t\u00eb informimeve p\u00ebr vepra penale? Kush do t\u00eb d\u00ebnoj\u00eb Komisionin kund\u00ebr Korrupsionit, q\u00eb ka detyr\u00eb q\u00eb \u00e7do gjasht\u00eb muaj t\u00eb dor\u00ebzoj\u00eb raport n\u00eb parlamentin p\u00ebr rezultatet e arritura t\u00eb ligjit? N\u00eb situat\u00ebn aktuale, komisioni as nuk ka material p\u00ebr t\u00eb p\u00ebrpiluar raportin, as nuk ka \u00e7far\u00eb t\u00eb prezantoj\u00eb para deputet\u00ebve, sepse ligji \u00ebsht\u00eb t\u00ebr\u00ebsisht i izoluar dhe vet\u00ebm paralajm\u00ebrimet nga jasht\u00eb, si e fundit nga Komisioni i Venedikut, mund t\u00eb iniciojn\u00eb zbatimin p\u00ebrkat\u00ebs. P\u00ebrndryshe, disi edhe opozita harroi ligjin, sepse p\u00ebr at\u00eb prioritet jan\u00eb zgjedhjet.<\/div>\n<div>Sllagjana Taseva nga \u201cTransparency International\u201d k\u00ebshtu i komenton dispozitat \u00a0rrepta ligjore p\u00ebr informator\u00ebt, q\u00eb i kritikon edhe Komisioni i Venedikut:<\/div>\n<div>&#8211; Denoncimi publik \u00ebsht\u00eb i mbrojtur vet\u00ebm kur informatorit ose ndonj\u00eb person t\u00eb af\u00ebrt ju \u00ebsht\u00eb rrezikuar jeta. Do t\u00eb thot\u00eb, vet\u00ebm n\u00eb situata kur ai vendos t\u00eb denoncoj\u00eb krim n\u00eb m\u00ebnyr\u00eb publike do t\u00eb tregoj\u00eb q\u00eb atij ose ndonj\u00eb t\u00eb af\u00ebrmi ju \u00ebsht\u00eb rrezikuar jeta, sh\u00ebndeti, siguria dhe mjedisi jet\u00ebsor, ose do t\u00eb shkaktojn\u00eb d\u00ebme me p\u00ebrmasa t\u00eb m\u00ebdha, ose n\u00ebse ka rrezik nga shkat\u00ebrrimi i d\u00ebshmive. E gjith\u00eb kjo \u00ebsht\u00eb shum\u00eb v\u00ebshtir\u00eb t\u00eb sigurohet si nj\u00eb qytetar n\u00eb kushte kur do t\u00eb doj\u00eb n\u00eb m\u00ebnyr\u00eb publike t\u00eb denoncoj\u00eb. Andaj themi q\u00eb kjo \u00ebsht\u00eb nj\u00eb prej rekomandimeve m\u00eb t\u00eb fuqishme t\u00eb Komisionit t\u00eb Venedikut, q\u00eb duhet t\u00eb zvog\u00eblohet shkalla e mbrojtjes, gjegj\u00ebsisht t\u00eb lejohet denoncimi publik n\u00ebse ka interes publik, nd\u00ebrsa \u201cfishk\u00ebllyesi\u201d nuk ka patjet\u00ebr t\u00eb kaloj\u00eb procedur\u00ebn e denoncimit t\u00eb brendsh\u00ebm dhe t\u00eb jasht\u00ebm dhe nuk duhet t\u00eb sigurohen k\u00ebto kushte.<\/div>\n<div><\/div>\n<div><\/div>\n<div><b>IDENTITETI I INFORMATORIT T\u00cb SHPALOSET VET\u00cbM ME LEJEN E TIJ\u00a0<\/b><\/div>\n<div><\/div>\n<div>\u00c7far\u00eb konkretisht parashohin rekomandimet e Komisionit t\u00eb Venedikut? E para, q\u00eb t\u00eb funksionon ligji duhet t\u00eb p\u00ebrshtatet me Ligjin p\u00ebr procedur\u00eb penale, me Kodin penal dhe me Ligjin p\u00ebr d\u00ebshmitar\u00eb t\u00eb mbrojtur pasi denoncuesi leht\u00eb mund t\u00eb b\u00ebhet d\u00ebshmitar. Rekomandimet thelb\u00ebsore t\u00eb komisionit kan\u00eb t\u00eb b\u00ebjn\u00eb pik\u00ebrisht me shkalla e lejueshm\u00ebris\u00eb e denoncimit publik, i cili sipas saj, \u00ebsht\u00eb vendosur tep\u00ebr lart\u00eb. Pse, q\u00eb t\u00eb fiton statusin e informatorit t\u00eb mbrojtur, \u201cfishk\u00ebllyesi\u201d duhet t\u00eb denoncon rastin nj\u00ebher\u00eb brenda, aty ku punon, pastaj jasht\u00eb \u2013 n\u00eb institucion kompetent shtet\u00ebror, kurse tek pas asaj n\u00eb mediet. Standardi nd\u00ebrkomb\u00ebtar parasheh denoncim publik, n\u00eb medie, madje edhe n\u00eb kushte ku nuk ka mund\u00ebsi p\u00ebr denoncim t\u00eb brendsh\u00ebm ose t\u00eb jasht\u00ebm, si\u00e7 \u00ebsht\u00eb rasti momental n\u00eb Maqedoni. Por sigurisht q\u00eb kjo nuk i konvenon kreut udh\u00ebheq\u00ebs.<\/div>\n<div>Q\u00eb t\u00eb del n\u00eb publik, nga informatori k\u00ebrkohet t\u00eb d\u00ebshmon se provat p\u00ebr aktivitetet e paligjshme mund t\u00eb shkat\u00ebrrohen, q\u00eb \u00ebsht\u00eb jasht\u00ebzakonisht v\u00ebshtir\u00eb. Gjithashtu, n\u00eb secilin rast korruptiv-penal nuk ka rrezik nga shkat\u00ebrrimi i d\u00ebshmive dhe pik\u00ebrisht p\u00ebr k\u00ebt\u00eb kusht kjo \u00ebsht\u00eb v\u00ebshtir\u00eb t\u00eb plot\u00ebsohet. Rekomandimi i Komisionit t\u00eb Venedikut thot\u00eb se ky kusht nuk duhet t\u00eb q\u00ebndron n\u00eb ligj.<\/div>\n<div>Ve\u00e7 k\u00ebsaj, Komisioni i Venedikut rekomandon q\u00eb t\u00eb formulohen rregullat e p\u00ebrgjithshme me t\u00eb cilat do t\u2019i lejohet gjyqit t p\u00ebrcakton kushtet n\u00ebn cilat mund t\u00eb shpaloset identiteti i informatorit. N\u00eb vendimin gjyq\u00ebsor thuhet se gjyqi, n\u00eb faz\u00eb t\u00eb caktuar t\u00eb procedur\u00ebs, n\u00ebse vet vler\u00ebson se \u00ebsht\u00eb e domosdoshme, mund t\u00eb shpalos identitetin e informatorit. Komisioni konsideron se \u00ebsht\u00eb e domosdoshme t\u00eb p\u00ebrcaktohen t\u00eb drejtat e anonimitetit dhe besueshm\u00ebris\u00eb q\u00eb mos t\u00eb ket\u00eb konfuzion, kurse informatorit ti lihet e drejta q\u00eb vet t\u00eb vendos n\u00ebse do t\u00eb shpalos ose jo identitetin e vet.<\/div>\n<div>Komisioni hap edhe dilem\u00ebn p\u00ebr dispozitat d\u00ebnuese q\u00eb parashohin sanksione deri gjasht\u00eb mij\u00eb euro p\u00ebr personin q\u00eb do t\u00eb shpalos identitetin e fishk\u00ebllyesit jasht\u00eb rregullave t\u00eb parapara. Kjo sipas saj, nuk \u00ebsht\u00eb shum\u00eb e mjaftueshme e t\u00eb hollave p\u00ebr t\u00eb parandaluar rrjedhjen keqdash\u00ebse t\u00eb informatave n\u00eb lidhje me informatorin.
